RELEASE, WAIVER AND ASSUMPTION OF RISK AGREEMENT RELATED TO HANG GLIDING AND/OR PARAGLIDING FOR THE EHGA. As a member of the EHGA ________________(Pilot) and the parent or legal guardian of Pilot (if pilot is a minor), for themselves, their personal representatives, heirs, executors, next of kin, spouses, minor children and assigns, do agree as follows:

DEFINITIONS:

PARTICIPATION IN THE SPORT means launching, assisting with launching, flying, and/or landing (including but not limited to crashing) a hang glider or paraglider.

SPORTS INJURIES means personal injury, bodily injury, death, property damage, any other personal or financial injury sustained by pilot as result of participation in the sport and/or as result of any EHGA activities. This also includes all pilot(s) under 18 years of age, their parents or legal guardians. RELEASED PARTIES means the following including owners, officers, directors, agents, spouses, officials (elected or otherwise), members, lessors and lessees: Lake Elsinore Hang Gliding Association

The United States Hang Gliding Association, a California Non-profit Corp. (USHGA)

Each of the person(s) sponsoring and/or participating in the administration of Pilots proficiency rating(s)

The United States of America and the city(ies), county, state and/or other political subdivision, governmental agencies including the Forest Service with whose jurisdictions the pilot launches, flies and lands.

Each property owner(s) on or over whose property the pilot may launch, fly, or land.

All persons involved including but not limited to spectators, hang glider and paraglider pilots and their equipment, assistants, drivers, instructors, and observers. All persons lawfully present at the flying sites during Pilot’s participation in the sport of hang gliding or paragliding.

I FOREVER RELEASE AND DISCHARGE THE RELEASED PARTIES from any and all liabilities, claims, demands, or causes of action that I may hereafter have for sports injuries, however caused even if caused by MY negligence. I WILL NOT SUE OR MAKE A CLAIM against any of the released parties for loss or damage due to sports injuries or participation in the sport. I VOLUNTARILY ASSUME ALL RISKS, KNOWN AND UNKNOWN IN THE PARTICIPATION OF THE SPORT AS WELL AS SPORTS INJURIES, HOWEVER CAUSED BY ACTION, INACTION, OR NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT ALLOWED BY CALIFORNIA LAW.

Use of the recreational facility for hang gliding shall be limited to those pilots in good standing with the USHGA and who have signed a personal death and injury waiver and agreement to indemnify all owners of the subject property, including CKS Western Development LLC, Western International Development LLC, Concordia Homes Development LLC, K.S. Chen, Alex Xu and the County of Riverside, Riverside County Flood Control District, and the Riverside County Board of Supervisors. USHGA or equivalent insurance shall be maintained at all times on the hang gliding facility at the expense of the hang gliding users.

I REPRESENT THAT PILOT is at least 18 years of age, or that I am the parent or legal guardian of said PILOT. I HAVE READ, UNDERSTAND, AND AGREE TO THE ABOVE RELEASE, WAIVER, AND ASSUMPTION OF RISK AGREEMENT.
